April Assets: Unlocking Spring’s Potential in Real Estate

View this email in your browser Hello April  Spring showers, flowers, pollen, spring break, and changes to our housing market. This past month the National Association of Realtors announced a proposed settlement regarding last fall’s class action lawsuit on commissions. There has been a lot of speculation in the press and social media regarding the outcome of the lawsuit and now the NAR settlement.  For our clients, friends, and future clients I wanted to weigh in on some changes you may see in your next real estate transaction as a result of the law suit and the settlement. First of all, at Jane & Co Real Estate, each agent has always been free to negotiate their commission with you, our clients. We are hopeful that one of the positive outcomes of this settlement will be that more agents are more transparent with their clients about how they are paid. What is changing (if the settlement is approved) is that buyers must now sign a Buyer Brokerage Engagement Agreement before we can show you homes. This contract that is between you the buyer, and the Buyer’s Broker, specifies exactly how the agent will be paid. The choices are many: the buyer can pay the broker directly at the closing table, the buyer can pay a retainer fee to the broker, the buyer can ask their agent to negotiate the commission to be paid by the seller, plus other options. The bottom line is that seller’s will no longer be able to offer to pay the Buyer Broker’s commission through the MLS.  We are here to assist you in buying or selling what is probably your largest financial investment. We will continue to look out for your best interests as we have always done.
